Arcteq Relays Oy (“Arcteq”) is committed to protecting the privacy and security of your personal information. This privacy policy describes how we collect and use personal information about you, in accordance with the General Data Protection Regulation (GDPR) as well as Chapter 24 (“Electronic direct marketing and cookies”) of the Act on Electronic Communications Services (917/2014).

This policy applies to all users of our website www.arcteq.com (“visitors”). We may update this policy at any time and will make an updated version available to you. Please refer to the top of this page to see the date of the last update.

3 What data do we collect?

3.1 Personal data

This data is collected for the following purposes:

  • Providing newsletters.
  • Creating, maintaining, and developing our products and services.
  • Website and newsletter analytics.
  • Crisis communication for visitors.
  • Supporting network and system security.
  • Protection of Arcteq’s intellectual property rights.
  • Identification.

We also collect the personal data provided by users registering for our website in their user profile. Apart from their username, all users can see, edit, and delete all of their personal data at any time. Please note that our website administrators can also see, edit, and delete that information.

3.2 Cookies

This website uses different types of cookies. Arcteq may collect cookie data to analyze the viewing patterns of our website’s visitors, but this data does not contain any personal information. These login cookies expires in two (2) days, while the screen option cookies expires in one (1) year. If you select “Remember me” during your login, the login information will expire in two (2) weeks. When you log out of your account, the login cookies will be removed.

If you edit or publish an article on the website, your browser will save one additional cookie. This cookie includes no personal data and simply indicates the post ID of the article you edited. This cookie expires after one (1) day.

4 Why do we collect your data?

Arcteq collects your data to comply with legislation and for legitimate business interests.

Some data is entirely based on your consent, such as subscribing to our newsletter. Some data processing is necessary to comply with legal obligations, such as to inform you of data breaches (crisis communication) or to ensure that personal data is not disclosed to the wrong person (identification). Some of the data is processed for the purposes of our legitimate interests to develop our business (such as website analytics, product/service development, as well as IP protection) and to maintain security on our website (for example, by monitoring data traffic and network security).

5 How long do we retain your data?

We will only retain your personal information for as long as it is necessary for us to fulfil the purposes it was collected for. We determine the appropriate retention period based on the amount, nature, and sensitivity of the personal data. We will also consider the potential risk of harm from unauthorized use or disclosure of your personal data. Additionally, we consider the purpose for collecting your personal information and whether we can achieve the same purpose through other mean while fulfilling the applicable legal requirements.

In some cases, we may anonymize your personal information so that it can no longer be associated with you. In this case, we may use such information without further notice to you. We may also be required to retain data longer for legal processes.

6 Who do we share your data with?

All personal data we collect can be received by the following parties:

  • IT system management service providers.
  • Information security service providers.
  • Other companies in our parent company Ensto Group.
  • Outside legal counsel.
  • Additional third parties as part of a merger or acquisition.

Please note that while most recipients are located in Finland or elsewhere in the EU or the EEA, some of the above-listed parties may be located or process data in third countries. This depends on the person whose data is being processed and the situation at hand. If Arcteq and/or the service providers processing data on its behalf transfer your personal data to countries outside the EU or the EEA, the transfer is subject to standard data protection clauses adopted by the EU Commission or other appropriate safeguards. This will be the case until such time that the EU Commission has found that the level of data protection is adequate in the country in question. 7 What rights do you have over your data?

You have the right to obtain a confirmation from us as to whether or not we process your personal data, and when we do process such data. Additionally, you have the right to obtain access to your personal data.

You have the right to have your inaccurate personal data corrected by us without undue delay. You also have the right to have any incomplete personal data completed.

You have the right to have your personal data erased by us without undue delay. Please note that the GDPR recognises situations, where data processing may be necessary even when you want to erase your personal data. We will always inform you separately of such circumstances and the grounds for processing.

You have the right to restrict the processing of your data in some situations. If your processing has been restricted, we will inform you before the restriction is lifted.

You have the right to receive your personal data that you have provided to us, in a structured, commonly used, and machine-readable format (such as XML). You also have the right to transmit such data to another controller. Please note that transmission of your data cannot adversely affect the rights and freedoms of others. You also have the right to have your personal data transmitted directly from us to another controller, where that is technically feasible.

You have the right to object to the processing of your personal data at any time on the grounds relating to your particular situation if the processing is based on our legitimate interests. After such objection, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing, or unless we need them for the establishment, exercise, or defence of legal claims.

If you are a consumer, you will receive electronic direct marketing (such as email newsletters) only if you have given us your consent to do so. You may withdraw your consent at any time. After such objection, your personal data will no longer be processed for such purposes.

You have the right to withdraw your consent at any time on all data processing based only on your consent. After consent withdrawal, we will no longer process your information for the purposes you originally agreed to unless we have another legitimate basis for doing so.

You have the right to lodge a complaint against us with a supervisory authority if we do not comply with applicable data protection legislation. The Finnish supervisory authority is the Data Protection Ombudsman. They can be contacted here.
